Today, I received a note from Diana Johnson of the Serenidad Hotel in Mulege.
She said they did sustain a lot of damage but they're working hard to get the hotel back in business. They're hoping to have a few rooms open by October 1st. The new kitchen is up and running (they had a fire last May or June).
Most of Mulege is still without phones or internet but the Hotel is able to receive emails.

I keep a California-registered pickup at my house near Los Barriles. I have re-registered it every year since 2005 without a smog check. My method is to submit the registration papers, including the smog test exemption request form (available on line) by mail to the DMV in Sacramento, together with a letter in which I (1) explain that the vehicle is located 1,000 miles south of the border; (2) state that I have no plans to return it to California within the foreseeable future; and (3) promise that if I do ever bring it back to California, I will have it smog tested immediately. Most years, this has been successful on the first attempt. Once, a couple of years ago, I was initially rejected and had to challenge the rejection by writing an even longer letter of explanation, which was accepted. Since then, I have made a point of enclosing copies of the previous year’s correspondence with my application and have (thus far) had no further problems.

New Regulations When Traveling With Dogs (courtesy, La Paz Gringos) - from Dhorea Ryon at Baja Dogs There is a new requirement for any dogs coming into Mexico from Canada and the U.S. -- each dog must have a separate document from a vet stating the dog has no worms or parasites. IRS Discussion - Please keep discussions to FACTS only. Thanks, Cheryl

a. 9/18/09-10:30 AM RMT - I just spoke minute ago with IRS Agent Tammy Oswald, of the Volutnary Disclosure Team resonsible for investigating off shore assests, she informed me categorically that Fideicomisos are NOT subject to IRS Form 3520 and 3520-A reporting rules, unless the property the Fideio is holding generates income as a rental property. Reporting on non-income property is required only at the time of sale, assuming a capital gain has been realized.
Agent Ozwald referred me to quetion #37, found on the "Voluntary Disclosure" link at:
www.irs.gov as an adequate and documentalble response to our questions regarding Fideiocomisos. I told Agent Oswald that there are many Websites for Tax Attorney's, based mainly in Southern Cal, that are using scare tactics on this topic, to generate business at a cost of upwards of $1000.00 a pop to file Forms 3520 and 3520-A, and her response was, and I quote, " Oh, I'm not at all surprised".
My suggestions is, talk to as many IRS Agents at the Voluntary Disclosure Office as possible, before you trust a Tax Attorney who claims to be a specialist on this topic.


b. I contacted my local IRS office and the people there had no clue as to what should be done. They referred me to their 800 number where the person I talked to there also had no clue and said get a professional tax accountant (I thought they were the professionals). I then called the IRS taxpayer advocate office, again explained the problem and this person stuck his neck out and said amend last year's and this year's 1040 by including Schedule B, Part II acknowledging ownership of a foreign trust and file in separate mailings, forms 3520 and 3520A ( these go to Utah) for both years. I have done all that. Now I will probably get a letter from IRS wanting a copy of the fide and when they get that they will send another letter saying My God it's in spanish and will want it translated. In a way I hope all the American fide holders do what I did. There are supposedly 3 million foreigners living in Mexico and lets say 50 percent of those are American and 20 percent of the Americans have fides. The IRS will have 300,000 sets of 3520 and 3520A to review and file. This sounds like a federal stimulus package. In Vietnam we had a word for this type of fiasco FUBAR.
