Fideicomisos and filing of IRS form 3520/3520-A. Earlier this month the IRS published a Private Letter Ruling (PLR) based on an earlier Revenue Ruling (RV). A couple used a US corporation to purchase a Condo in the Mexican restricted zone with title held in a Fideicomiso. In their request for a PLR concluding that their fideicomiso is not a foreign trust, they stated, under penalty of perjury, that they did not intend to use this property in a business or to rent or lease it for income. Further, they stated that if this became the case they would report any income to the IRS on their annual tax return. Other conditions were used in their argument as well as the RV ruling that a particular Illinois Land Trust was not reportable on form 3520. The PLR just published, which cannot be used by others as precedent since it is based on the specific conditions around this particular fideicomiso, states that this fideicomiso is not a foreign trust and need not be reported to the IRS. Whether the IRS will make a general ruling is still unknown. Hopefully they will, but at least the argument based on the ILT Revenue Ruling can be used by others if they are hassled by the IRS. This is very timely as the draft instructions for IRS form 3520 for 2012 seem to imply, as several US law firms have written, that whether one uses property in a foreign trust or not, they must report as income the fair market value the property could have or did generate since March 2010 and every year going forward. BAJA NIGHT SKIES
Nov. 30 - December 7 -- 1. Morning Planets and Constellations:  For early risers, go outside by 5:30am for a dark sky.  Look for a very bright Venus rising in the east.  With dawn approaching, you will need  sharp eyes or binoculars to spot Mercury, just below Venus, and Saturn just above. Look high in the northern sky for the up-side-down Big Dipper with its last two bowl stars pointing down at Polaris, the north star. Jupiter is close to setting  in the west;  just south of Jupiter, Orion is setting.  2. Evening Planets and Constellations: By 7pm in the evening, Jupiter is the bright planet rising in the east. An hour later the constellation Orion is just rising in the southeast. High overhead to the north is the Great Square of Pegasus. Using binoculars, scan the sky between the NE corner of the square and the M-shaped constellation Cassiopeia, lower in the northern sky, to find the faint spiral of the Andromeda Galaxy.  3. International Space Station (ISS):  The International Space Station (ISS)  returned to make an early Friday morning pass visible from all of Baja Sur. It will make passes each morning between 5 and 6am thru December 5.  For early morning risers in most locations, the brightest and most interesting ISS pass will be on Tuesday morning, December 4.  At 5:49am look for it rising low in the NW sky near the star Capella. Rivaling Venus in brightness, the giant space station with its three-man crew will make a six-minute crossing from the NE to SW.  A few seconds after 5:50am, the ISS will pass Castor and Pollux in Gemini, and half a minute later it will pass near the moon high in the southern sky. For the next 4 minutes it will continue SW  before going back into Earth's shadow (over Punta Arena from La Ventana).  On December 21, three more astronauts will blast off to give the Space Station a six-man crew of Americans, Canadians, and Russians. Check  back next week for information on the ISS's next bright evening pass on Saturday, December 8, when it will graze the Andromeda spiral galaxy.  Tom S.

a.   I  flew both out and back in this week and it was Terminal One both times.  While there I made note of the airlines at T1: American Airlines, US Airways, United to Houston, InterJet, Volaris.  T1 was very busy both days.

b.  Appliance repair:  Jose Marquez fixed several appliances in our house and on our boat.  He is from San Jose and comes to the Los Barriles area about once per month when he has enough work lined up but will also come for an emergency at a slightly higher cost.  He did excellent work at fair pricing and I highly recommend him.  His home number is 146-0921 so call early or late while he is not out on service calls.  Spanish speaking only.  He is also the Whirlpool warranty repair man and that phone number is 01-800-8300400.   Mary@fedorka.com
